Terms and Conditions

 

I.   Description of the Program

a.  The Buzz Points Rewards Program ("Program") is a service provided by Cornerstone Financial Credit Union ("Financial Institution") and managed by Buzz Points, Inc. ("Buzz Points").

 

b.   Participation in the Program is exclusive to those who have an eligible account, with a credit or debit card issued by Financial Institution ("Card"). These individuals are defined as ("Cardholder"). For certain Cards, Cardholder may enroll in the Program. For other Cards, Cardholder will be automatically enrolled in the Program.

 

c.   Financial Institution reserves the right to disqualify any Cardholder from participation in the Program and invalidate all Points for abuse, fraud, or any violation of the Program terms and conditions. Financial Institution may make such a determination in its sole discretion. 

 

d.   Financial Institution and Buzz Points reserve the right to change the terms and conditions, including point earnings ratios and points required for a reward within the Program. At Financial Institution's option, redemption of Points may be restricted, limited, expired or cancelled at any time without prior notice.

II.  Rewards

            Earning Points.

a.       Cardholder will earn points ("Points") for qualifying transactions using their eligible Card and for other actions as determined by Financial Institution.  Qualifying transactions and actions are set forth on Financial Institution's Buzz Points landing page .

 

b.      Points will be accumulated at the rate of 1 point per every $4.00 charged to Cardholder's Card. Financial Institution may increase or decrease earnings rates at its sole discretion. Current earnings rates are set forth on Financial Institution's landing page.  Unless otherwise indicated, the maximum number of Points that can be earned per qualifying transaction is 1,000.


c.       Where multiple Cards are issued under a primary Cardholder's account, Points will be earned for each Card associated with the account and the Points earned will be combined in the account.


d.      Points earned for other Financial Institution relationships, products or services are determined in the sole discretion of Financial Institution.


e.       Financial Institution reserves the right to award bonus Points to selected Cardholders for any activity or condition it decides.


f.        Points will be reflected in Cardholder's Buzz Points account. Subject to eligibility, verification and settlement of the qualifying transaction, Points will typically appear in the account approximately 5 days after the qualifying transaction, but may be subject to delays.


g.      Point earnings are based on the corresponding transaction (i.e., if a transaction is reversed or adjusted, the point earnings are also reversed or adjusted). If a transaction is subject to a billing dispute, the Point value of the transaction may be deducted from the Point total during the dispute period. If the transaction is reinstated, Points will be reinstated.


h.      Points cannot be processed if the Card number expires or changes while Points are pending, or the Card account is not open or in good standing.


i.        In no event shall any Payment Service Provider constitute or be considered as maintaining any type of financial obligation or deposit or other asset account or holding funds or other value for Cardholder for distribution to Cardholder. Any pending statement credits and any associated dollar values represent offer fulfillment amounts in process owed by Financial Institution, and not funds or balances maintained or held by a Payment Service Provider or Buzz Points.


j.        Points may not be combined with any other loyalty/frequency reward program that is not managed by Financial Institution.


k.      Financial Institution and Buzz Points shall have no liability for disagreements between Cardholder regarding Points. Financial Institution's decisions regarding Point discrepancies shall be final.

 

            Merchant Funded Points.

 

l.        Cardholder can earn additional Points from participating merchants when using their Card for purchases at participating merchants, both online and in-store. Point earnings will vary based upon the merchant and the offer. By providing your email address when you register on the Program's website, you can agree to receive future merchant funded correspondence and notices electronically to that email address. Email is the primary method for contacting Cardholder regarding their participation in the Program. It is Cardholder's responsibility to update or change the email address on file. New merchant offers are updated periodically. There is not a limit to the number of times a Cardholder can earn Points for shopping at a merchant.

 

     Redeeming Points

     Real-Time Rewards.

m.    A "Real-Time Reward" is an offer of a reward that is available by redeeming Points at a specified merchant using the Cardholder's "linked" eligible Card. Real-Time Rewards take various forms, which may change from time to time. Some offers require Cardholder to "claim" a specific merchant offer, some may require an upfront purchase at a specified merchant. Multiple Real-Time Rewards may not be redeemed at one time, in one transaction, with one participating merchant. (Multiple rewards will not be awarded)

n.      A "reward" is the amount offered to Cardholder in connection with a qualifying transaction, either as cash back, issued as a credit on Cardholder's upcoming statement for the Card, as Points, or in another form as described in the applicable reward. When Cardholder makes a qualifying transaction, Cardholder pays the full purchase price at the time of the transaction and, after the purchase has been confirmed as a qualifying transaction, the reward will be provided to Cardholder. ) A "qualifying transaction" is a purchase made for at least the amount of the reward before tax or tip. A transaction that does not meet this minimum will not be treated as qualifying and a reward will not be awarded.

o.      Credit card transactions can generally be monitored to identify qualifying transactions, Visa and Mastercard debit card transactions will be eligible for statement credits if run as "credit" transactions (i.e., use a signature, not a Personal Identification Number ("PIN"), to complete the applicable qualifying transaction). The following purchases will not be treated as qualifying transactions (and rewards will not be awarded for these purchases): (i) use of a PIN when paying with a Card; (ii) any transaction that is not directly processed or submitted through the Visa and Mastercard payment systems, as applicable; and (iii) any purchase a Payment Service Provider is unable to monitor (including purchases initiated through identification technology that substitutes for a PIN and transactions made through a payment method such as a digital wallet or a third party payment product where the Card is a funding source but the Card is not presented directly to the merchant). The determination as to what transactions are qualifying transactions shall be made by Financial Institution in its sole discretion.

p.      Statement credits will not appear or be reflected on any transaction receipt from a merchant at the time of purchase. Subject to eligibility verification and settlement of the qualifying transaction, statement credits will typically appear on the Card statement approximately 7-10 days after the final qualifying transaction but may be subject to delays. Statement credits may constitute taxable income to Cardholder. Compliance with any applicable tax requirements is Cardholder's responsibility. Statement credits cannot be processed if the Card number expires or changes while statement credit is pending and not settled, or the Card account is not open or in good standing. Cardholder may not receive the value associated with the reward if the applicable issuer does not post the statement credit. Financial Institution, Buzz Points, and the Payment Service Provider will have no responsibility or liability for the failure of a statement credit to be posted. Neither Buzz Points nor the Payment Service Provider is responsible for any finance or other charge, or impact on any rewards, feature, or term of Cardholder's account resulting from the statement credit; Financial Institution is responsible for all such charges or impacts.

     

III. Redeeming Points

a.       To be eligible to redeem Points, Cardholder's account must be open (meaning not voluntarily closed, canceled or terminated for any reason) and the Card cannot have any other status preventing authorizations.

 

b.      Cardholders can view their Point balance, view any new Points earned, and redeem Points at any time in their Buzz Points' account.

 

c.       Points are tracked and redeemable on a first-in, first-out basis. Points will expire on the last day of the month, 2 years after the date of issuance.

 

d.      Points are deducted from Cardholder's Point balance as soon as they are redeemed.

 

e.       Points must be redeemed by Cardholder but can be used to provide a reward or electronic gift card for another person of their choice.

     

     Gift Cards and Certificates.

a.   Points may be redeemed for electronic gift cards and certificates from select merchants.

b.   Gift cards and certificates cannot be returned and are not redeemable for cash or credit.

c.   All other sales and/or use taxes and handling charges of items purchased using a gift card or certificate are the responsibility of Cardholder and are subject to the merchants' policies in effect at the time of redemption. Purchases in excess of the amount of the gift cards are at Cardholder's expense.

d.   Gift cards and certificates may also be subject to other restrictions imposed by the merchant. Gift cards and certificates purchased to provide services are subject to the terms and conditions of the vendor providing the services.

e.   Additional terms and conditions may be specified on the gift card or certificate.

f.    If a merchant declares bankruptcy, Financial Institution and Buzz Points are not liable for the underlying funds on the gift card or certificate.

g.   Once the gift card or certificate is redeemed and/or used, they are not returnable, exchangeable or replaceable.

h.   Each merchant sets a policy regarding lost or stolen gift cards or gift certificates. If a gift card or certificate is lost or stolen Cardholder should report the occurrence to Buzz Points immediately. Buzz Points reserves the right to decline to replace lost or stolen gift cards or certificates.

 i.   If gift cards or certificates have been ordered and not received by Cardholder, Cardholder must notify Buzz Points no later than 30 days from the order date. Upon receipt of such notification, Buzz Points will investigate. Buzz Points in its sole discretion may replace any non-received gift card or certificate, in which a full balance remains on the gift card or certificate.

IV. Transaction Monitoring

a.    Cardholder transactions will be monitored by a payment network or platform or a third-party authorized by Financial Institution (each, a "Payment Services Provider").  Buzz Points will notify the applicable Payment Services Provider when a Cardholder has enrolled in the Program and provide Cardholder's Card number to the Payment Services Provider, and the Payment Services Provider will notify Buzz Points when it identifies, and provide details of, a qualifying transaction. Each Cardholder authorizes Buzz Points and the relevant Payment Services Provider to provide such notifications and engage in such monitoring.

b.    Cardholder authorizes (i) Buzz Points to inform its Payment Services Provider so the Payment Services Provider knows Cardholder is enrolled in the Program; (ii) its Payment Services Provider  to monitor transactions on its Card(s) to identify qualifying transactions in order to determine whether Cardholder has qualified for or earned Points, Real-Time Rewards or an offer linked to its Card, and for the Payment Services Provider to share such transaction details with Buzz Points to process Points and rewards; and (iii) its Payment Services Provider to initiate and process statement credits as requested by Buzz Points in connection with Points and rewards. Cardholder may opt-out of transaction monitoring on a Card by clicking the "Unlink Card" link below the enrolled Card on the Program's website.

V.  Miscellaneous

a.   Cardholder agrees to release Financial Institution and Buzz Points, and its vendors from all liability for any injury, accident, loss, claim, expense or damages sustained by Cardholder, associated with a reward or use of Points while participating in this Program. Buzz Points and Financial Institution shall not be liable for consequential damages, and the sole extent of liability, if at all, shall not exceed the actual value of the reward or relevant Points.

b.      Cardholder is responsible for determining any tax liability arising from participation in the Program. Consult a tax advisor concerning tax consequences.

 

c.      Financial Institution and Buzz Points shall have no liability for disagreements between Cardholder and Financial Institution regarding Points.  Discrepancies about Point earnings are not treated as billing disputes.  Financial Institution's decision regarding Point discrepancies shall be final.

 

d.      The Program is void where prohibited by federal, state, or local law. 

 

e.       Certain categories of merchants may be excluded from the Program as required by law or for other considerations as determined by Buzz Points and Financial Institution.

     

f.       Eligibility in the Program is restricted to individuals who have a statement address within the 50 United States, the District of Columbia or any U.S. Possession or Territory.

 

g.       Points are not the property of Cardholder, and cannot be bought, sold or transferred in any way (including, but not limited to, upon death or as part of a domestic relations matter).

 

h.      Cardholder understands and agrees that Buzz Points will access and use data about qualifying transactions made by Cardholder. Cardholder agrees that Buzz Points may use the transaction data to:


-         confirm a qualifying transaction or return made by Cardholder at a participating merchant;

-         confirm whether Cardholder qualifies for Points or a reward;

-         share transaction data with a participating merchant to confirm whether a specific transaction has occurred;

-         create a record of the transaction data to verify and maintain a record of Cardholder's purchases;

-         provide participating merchants reports concerning activity as it relates to merchant offers;

-         provide Cardholder with targeted offers for products and services from Financial Institution and merchants;

-         perform analytics regarding the performance of the Program and specific offers and rewards;

-         communicate with Cardholder concerning transactions and provide general customer service and respond to Cardholder inquiries; and

-         respond to legal, regulatory and audit requests and resolve disputes and defend claims against or by Buzz Points.

i.       Cardholder authorizes and agrees to receive targeted, complementary and/or location-based offers in real-time. Such offers may be presented in various ways, including via email, push notifications, and within the Program website. In addition, Cardholder agrees that Buzz Points may use transaction data in accordance with the Buzz Points Privacy Policy in ways that are consistent with the above. Cardholder authorizes the sharing, exchange and use of transaction data in connection with Cardholder's Card by and among Buzz Points, Buzz Points' third-party service providers, applicable Payment Service Providers and applicable merchants, as described herein and in the Buzz Points Privacy Policy. Please refer to the Buzz Points  Privacy Policy to learn more about the data collection, use, and sharing practices in connection with the Program.
